Terms for Mahajan/Organization/Hostel/Company (U/S 8 of the Companies Act, 2013)
Evergreen Digital Solution develops and manages the LB - Lohana Book web portal and mobile application on behalf of the Lohana community. This page sets out the terms and conditions that apply when a Lohana Mahajan, Organization, Hostel, or Company registered under Section 8 of the Companies Act, 2013 (or an equivalent registered entity) creates an organization account on the portal.
By registering an organization account, the authorized person submitting the registration confirms that they have read, understood, and agreed to these terms on behalf of the Mahajan, Organization, Hostel, or Company named in the registration form.
- Only genuine Lohana Mahajans, Lohana Samaj organizations, hostels, or companies lawfully registered under Section 8 of the Companies Act, 2013 (or equivalent applicable law) may register on this portal.
- The registering organization must provide the correct legal name of the Mahajan, Organization, Hostel, or Company exactly as registered with the relevant authority.
- The authorized person named in the registration must be duly authorized by the organization to create and manage the account, and must provide accurate contact details, designation/role, and government-issued identity proof.
- The email address submitted at registration will be used as the organization Log In ID. The organization is responsible for safeguarding its login credentials and for all activity conducted through the account.
- Organization registration remains subject to verification and approval by the portal administrators. Evergreen Digital Solution may reject, suspend, or terminate any organization account if the information submitted is false, incomplete, misleading, or not supported by valid documents.
- The organization must not use the portal to publish obscene, offensive, political, communal, or uncivilized content, or to promote unauthorized commercial advertising, donation appeals, or fundraising without prior written authorization from Evergreen Digital Solution.
- Photos, videos, news, booking information, and other content posted by the organization must be truthful, lawful, and respectful of the Lohana community and applicable laws.
- Evergreen Digital Solution is not responsible for disputes arising between the organization and its members, visitors, tenants, guests, or third parties in connection with bookings, events, donations, or any other arrangement made through or outside the portal.
- Registration and use of the portal are currently free of charge for organizations, but Evergreen Digital Solution reserves the right to introduce fees or revised service terms in the future.
- Evergreen Digital Solution may display advertisements on the portal and mobile application and reserves the right to revise these terms at any time. Continued use of the organization account after such revision constitutes acceptance of the updated terms.
- These terms are legally binding under the laws of India. The courts of Bhavnagar District, Gujarat State, India shall have exclusive jurisdiction over any dispute arising from organization registration or use of this portal.
મહાજન/સંસ્થા/હોસ્ટેલ/કંપની (કંપનીઝ એક્ટ, ૨૦૧૩ ની કલમ ૮ હેઠળ) માટેની શરતો
Evergreen Digital Solution લોહાણા સમાજ માટે LB - Lohana Book વેબ પોર્ટલ અને મોબાઇલ એપ્લિકેશન વિકસાવી અને સંચાલિત કરે છે. જ્યારે લોહાણા મહાજન, સંસ્થા, હોસ્ટેલ અથવા કંપનીઝ એક્ટ, ૨૦૧૩ ની કલમ ૮ હેઠળ (અથવા સમકક્ષ કાયદા હેઠળ) નોંધાયેલી કંપની પોર્ટલ પર સંસ્થા એકાઉન્ટ બનાવે છે, ત્યારે આ શરતો લાગુ પડે છે.
સંસ્થા એકાઉન્ટ નોંધણી કરીને, નોંધણી ફોર્મમાં નામ આપેલી મહાજન/સંસ્થા/હોસ્ટેલ/કંપનીની તરફથી અધિકૃત વ્યક્તિ આ શરતો વાંચી, સમજી અને સ્વીકારી છે તેની પુષ્ટિ કરે છે.
- ફક્ત વાસ્તવિક લોહાણા મહાજન, લોહાણા સમાજની સંસ્થાઓ, હોસ્ટેલ અથવા કંપનીઝ એક્ટ, ૨૦૧૩ ની કલમ ૮ (અથવા સમકક્ષ કાયદા) હેઠળ કાયદેસર નોંધાયેલી કંપનીઓ જ પોર્ટલ પર નોંધણી કરી શકે છે.
- નોંધણી કરતી સંસ્થાએ સંબંધિત અધિકારી પાસે નોંધાયેલ નામ મુજબ મહાજન/સંસ્થા/હોસ્ટેલ/કંપનીનું ચોક્કસ કાયદેસર નામ આપવું જરૂરી છે.
- નોંધણીમાં નામ આપેલી અધિકૃત વ્યક્તિ સંસ્થા દ્વારા ખરેખર અધિકૃત હોવી જોઈએ અને સાચી સંપર્ક વિગતો, હોદ્દો/ભૂમિકા અને સરકારી ઓળખપત્ર રજૂ કરવું જરૂરી છે.
- નોંધણી સમયે આપેલ ઇમેઇલ સંસ્થાનું Log In ID તરીકે ઉપયોગ થશે. લૉગિન વિગતોની સુરક્ષા અને એકાઉન્ટ દ્વારા થતી બધી પ્રવૃત્તિ માટે સંસ્થા જવાબદાર રહેશે.
- સંસ્થા નોંધણી પોર્ટલ વહિવટકારોની ચકાસણી અને મંજૂરીને આધીન રહેશે. ખોટી, અપૂર્ણ, ગેરમાર્ગે દર્શાવતી અથવા માન્ય દસ્તાવેજોથી સમર્થિત ન હોય તેવી માહિતી મળે તો Evergreen Digital Solution એકાઉન્ટ નકારી, સસ્પેન્ડ અથવા સમાપ્ત કરી શકે છે.
- સંસ્થાએ પોર્ટલનો ઉપયોગ અશ્લીલ, અપમાનજનક, રાજકીય, સામ્પ્રદાયિક અથવા અસભ્ય સામગ્રી પ્રકાશિત કરવા, અથવા પૂર્વ લેખિત મંજૂરી વિના અનધિકૃત જાહેરાત, દાન અપીલ અથવા ફંડ ઉભારણી માટે કરી શકશે નહીં.
- સંસ્થા દ્વારા પોસ્ટ કરેલી ફોટો, વિડિયો, સમાચાર, બુકિંગ માહિતી અને અન્ય સામગ્રી સાચી, કાયદેસર અને લોહાણા સમાજ તથા લાગુ કાયદાઓનું માન રાખતી હોવી જોઈએ.
- બુકિંગ, કાર્યક્રમ, દાન અથવા પોર્ટલ દ્વારા અથવા બહાર થતા અન્ય કરારોને લગતા સંસ્થા અને તેના સભ્યો, મુલાકાતીઓ, મહેમાનો અથવા તૃતીય પક્ષો વચ્ચેના વિવાદો માટે Evergreen Digital Solution જવાબદાર નથી.
- સંસ્થાઓ માટે હાલમાં નોંધણી અને ઉપયોગ નિઃશુલ્ક છે, પરંતુ Evergreen Digital Solution ભવિષ્યમાં ફી અથવા સુધારેલી સેવા શરતો લાગુ કરવાનો અધિકાર રાખે છે.
- Evergreen Digital Solution પોર્ટલ અને મોબાઇલ એપ્લિકેશન પર જાહેરાતો દર્શાવી શકે છે અને કોઈ પણ સમયે આ શરતોમાં ફેરફાર કરવાનો અધિકાર રાખે છે. ફેરફાર પછી એકાઉન્ટનો ચાલુ ઉપયોગ અપડેટેડ શરતોની સ્વીકૃતિ ગણાશે.
- આ શરતો ભારતના કાયદા હેઠળ કાયદેસર રીતે બંધનકર્તા છે. સંસ્થા નોંધણી અથવા પોર્ટલના ઉપયોગથી ઉદ્ભવતા કોઈ પણ વિવાદમાં ભાવનગર જિલ્લાની કોર્ટ, ગુજરાત રાજ્ય, ભારતની વિશિષ્ટ અધિકારક્ષેત્ર હશે.
